Probate is the legal name given to the process of passing ownership of property from a decedent to his heirs. This process is either conducted pursuant to a will (testate) or under the laws of the state (intestate). A number of potential issues can arise prior to death that could raise legal issues relating to the probate process. Technical challenges to the will or undue influence or coercion by heirs are just two examples of issues that arise.
